 WHAT IS MEDIATION?

Mediation is generally defined as the intervention in a negotiation or a conflict of an acceptable third party who has limited or no authoritative decision-making power, which assists the involved parties to voluntarily reach a mutually acceptable settlement of the issues in dispute.

In addition to addressing substantive issues, mediation may also establish or strengthen relationships of trust and respect between the parties or terminate relationships in a manner that minimizes emotional cost and psychological harm.

Argentina to meet again with debt mediator, bonds rise

(Reuters) - Argentina said on Tuesday it would meet with a mediator for the second time this week in the country's dispute with "holdout" investors, lifting market hopes for a deal needed to avoid another painful debt default. With the economy already in recession, President Cristina Fernandez's cash-strapped government has until July 30 to reach an agreement with hedge funds who refused to participate in the country's earlier debt restructuring and have been suing for full repayment of sovereign bonds which Argentina defaulted on in 2002.

Being Grateful for Whatever Comes

Most mediation training sessions in the United States usually end somberly with handshakes, the exchange of business cards and perhaps a last bite of the refreshments that have been laid out for snacks during the day. Not so with the energetic group of mediators and facilitators who completed the third and final leg of training of the Athens Migration Dialogue Project April 7-12 in Athens, Greece.

Can Iran's Diplomatic Status Change from Meddler to Mediator?

Vienna, Austria – As the U.S. and other Western powers meet for talks with Iran over its nuclear program, the issue of Iraq has shown how Tehran’s diplomatic fortunes might be changing. The consistent rhetoric from Washington and its allies has been that Iran meddles in its neighbors’ affairs by sponsoring overseas terrorism –whether it be in supporting Hezbollah, targeting Israelis abroad or trying to stir up turmoil in the Middle East. But this is not a narrative you hear much of these days.

A Song of Loss for Divorce Mediators

I was recently asked to give a presentation in an advanced seminar on Mediating with Families in Transition.  I thought at first of the many film scenes that I and others have used, from the opening of Wedding Crashers to the moment in The War of the Roses when Michael Douglas gloats that he has “won” the negotiation to divide the house where he and Kathleen Turner will remain living until the settlement: “I got more square footage.”

ADR may put courts out of (small) business

Paul Pearson said that before anything else in a dispute, it’s important that both parties consider mediation as part of the resolution process. Pearson, a former attorney at Hodgson Russ who became a full-time mediator, said the process is accepted in virtually all areas of client disputes, including and more frequently in matrimonial and family law.

Conflict Mediation Through Sport

This week, the world’s attention will refocus from domestic issues to the international stage of the World Cup in Brazil. While domestic Israeli politics never has a dull moment, today we bring you a story about the Italian football superclub “FC Inter Milan” and the social work they recently completed in Israel/Palestine. Four years ago FC Inter Milan won the Champions League Final, the premier tournament for European football clubs, and today is sending 8 players to represent their respective countries at the World Cup in Brazil.
